Terms and Conditions of Services

Access for services

The customer will provide, at no cost to Parkshot Mechanics, adequate and safe access and all necessary facilities including but not limited to, power and lighting, for the purposes of undertaking agreed work.

If the customer fails to provide adequate and safe access, Parkshot Mechanics may decline to continue with the work. In this instance, the customer may still be charged a travel fee even if the work is not carried out.


Estimates

All quotes and estimates are valid for 7 days. Prices are based on the information available at the time and may be subject to change if additional faults are found or there is an increase in cost of goods. Parts pricing and availability may vary. We will endeavour to seek your consent prior to completing additional work required to remedy additional faults discovered during the job, where appropriate. Booking the job is acceptance of the quote or estimate and you are liable to pay the full amount charged when it falls due.


Late payment

Failure to make payment by the due date will incur interest on all amounts overdue at the rate of 10% per month or part month and is calculated on a daily basis on the outstanding balance until payment is received in full.


Ownership & Recovery of Goods

All goods / parts supplied as part of the job will remain the property of Parkshot Mechanics until full payment is made. If payment is not made on time, Parkshot Mechanics may recover any parts (goods) provided to the Customer. The Customer agrees that Parkshot Mechanics may (without prejudice to any of its other rights) enter the Customer's premises or any other place where the Goods / parts are stored and take possession of and sell the Goods (and the Customer grants to Parkshot Mechanics an irrevocable right and authority to so recover, re-enter and re-sell), provided that Parkshot Mechanics may only recover and re-sell for its own account sufficient Goods / parts to satisfy all unpaid liabilities in respect of the Goods / parts and the costs of resale and any costs incurred for labour. Parkshot Mechanics can so recover, re-enter and re-sell even if Parkshot Mechanics does not have priority over other persons having a "security interest" (as that term is defined in the Personal Property Securities Act 1999 (the "PPSA") in the Goods / parts. Sections 108, 109 and 120 of the PPSA do not apply to the extent that they are inconsistent with this clause.


Liability

Parkshot Mechanics liability will be limited to the value of the job undertaken out of which any liability arose. New Zealand laws may imply warranties or conditions or impose obligations upon Parkshot Mechanics which cannot be law (or which can only to a limited extent be law) be excluded or modified. In respect of any implied warranties, conditions obligations or terms on Parkshot Mechanics, Parkshot Mechanics liability will, where allowed, be excluded or if not able to be excluded, only apply to the minimum extent required by the relevant statute. 

Except as otherwise provided above, Parkshot Mechanics will not be liable for any loss or damage of any kind whatsoever arising from the supply of goods or services by Parkshot Mechanics to the customer, including special, indirect or consequential loss or damage whether suffered or incurred by the customer or another person, and whether in contract or in tort (including negligence), or otherwise and irrespective of whether such loss or damage arises directly or indirectly from the goods or services supplied by Parkshot Mechanics.

The customer indemnifies Parkshot Mechanics and its officers, directors, agents, advisers and employees against all actions, proceedings, losses, damages, liabilities, claims, costs, expenses, and loss of any kind whatsoever however caused or arising on a full indemnity basis and without limiting the generality of this clause, whether caused or arising as a result of the negligence of Parkshot Mechanics or otherwise, brought by any person in connection with any act, matter, omission or error by Parkshot Mechanics, its agents or employees in connection with the goods and services.
 

Warranty

Parkshot Mechanics will not be liable for damage, loss or injury suffered as a result of any person failing to follow instructions relating to usage or installation of any goods / parts or other materials supplied as part of work carried out for the customer. This includes where the customer fails to appropriately maintain or store them or using them for an unintended purpose(s). 


Risk

From the time the goods / parts are supplied to the customer by Parkshot Mechanics, risk in all goods / parts supplied will pass to the customer, and any loss, damage or deterioration of the goods/parts will be borne by the customer. The customer, not withstanding any loss, damage or deterioration, remain liable to pay for the goods / parts in full. 


Other agreements

If there is any inconsistency between these Terms and any arrangement between the customer and Parkshot Mechanics, or any terms supplied elsewhere, these terms prevail, unless otherwise agreed in writing by both parties.
